Amendments to the Regulations on Fees of Rospatent come into force from October 5, 2024

On October 5, 2024, the Amendments to the Regulations on Fees of Rospatent come into force. The amendments include adjustment of fees, introduction of a grace period of payment of the prescribed fees, change of period of payment of annuities and etc.

1. Adjustment of fees

In addition, the annuities of patent for invention, utility model and design are deleted before 6th year in the fees tables because they are included in the registration, publication and grant fees. At the meantime, the annuities for 6th year and each year thereafter are increased with a range from 10% to 20%.

2. Introduction of a grace period of payment of the prescribed fees
For the payment of the application fee and Registration, Publication and Grant fee of patents for invention, utility model and industrial design, an additional period of 12 months from the date of expiration of the period for payment shall be granted, subject to payment of a duty in an amount increased by 100 percent.

3. Change of period of payment of annuities
The annuities of patents for invention, utility model or industrial design should be paid for 5-year periods at a time. The annuities for 1st to 5th year should be paid together with the fee for registration, publication and grant and the payment for annuities of next 5 years should be made before the expiration of the protection period.
