Unitary Patent will be Operational as of 1 June 2023
According to the news from EPO website on 6 December 2022 that the starting date of the transitional measures offered by the EPO remains unchanged, which is 1 January 2023, and the Unitary Patent system is expected to start on 1 June 2023. This means that the Agreement on a Unified Patent Court (UPCA) will enter into force, and that the two EU Regulations setting up the Unitary Patent will apply. From 1 January 2023, applicants may file early requests for unitary effect and request for a delay in issuing the decision to grant a European patent. The two transitional measures are applicable until the entry into operation of the Unitary Patent Protection system, which is expected to be on 1 June 2023.
